Buddycare and its affiliates provide you access to the buddycare.co.uk web site (the "Web Site") and sell our products to domestic keepers of animals only, subject to the terms and conditions set out on this page. Please read these conditions carefully before using the Website. By using the Website, you signify your agreement to be bound by these terms and conditions. 

1. Your Account
   If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

Please ensure that the details you provide us with are correct and complete when registering. In the event that there is a change to your personal information, for example your contact details, please login to your account and update your details so that we keep your information up to date and accurate.? 

Buddycare reserves the right to refuse access to the Web Site, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you. 

2. Privacy
   Please review our Privacy Policy, which also governs your visit to the Website, to understand our practices.
3. Access to the Buddycare Website, buddycare.co.uk

We will try to ensure that availability of the Website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the Website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. 

4. Your conduct
   You shall not access, store, distribute or transmit any viruses, or any material during the course of your use of the Services or website that:
5. a) is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing, racially or ethnically offensive;

   d) promotes unlawful violence;

4.2 Buddycare reserves the right, without liability or prejudice to its other rights to you, to disable your access to any material that breaches the provisions of this clause. 

4.3 In your use of this service, you must not; 

1. a) except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties:
   i. and except to the extent expressly permitted under this agreement, attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Services or website in any form or media or by any means; or
   attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Software; or 
   b) access all or any part of the Services or website in order to build a product or service which competes with the Services and/or website; or 
   c) unless otherwise agreed, license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Services and/or website or any content available to any third party except the Authorised Users, or 
   d) attempt to obtain, or assist third parties in obtaining, access to the Services and/or website other than as permitted in writing. 
   e) allow any unauthorised access to, or use of, the Services and, in the event of any such unauthorised access or use, promptly notify Buddycare. 
   f) conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent. 
   g) use data collected from our website or our directory to contact individuals or companies or other organisations (for any reason). 
   h) use data collected from our website or our directory for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).

   All content included on the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Buddycare and its affiliates or its content suppliers and is protected by United Kingdom and international copyright and database right laws. The compilation of all content on this Website is the exclusive property of Buddycare and its affiliates and is protected by United Kingdom and international copyright and database right laws. All software used on the Website is the property of Buddycare and its affiliates and suppliers and is protected by United Kingdom and international copyright laws.

You may not systematically extract and/or re-utilise parts of the contents of the Website without Buddycare's express prior written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation any substantial part of this Web site, without Buddycare's express written consent. You also may not create and/or publish any database which features substantial parts of the Website (e.g. Buddycare’s prices and product listings) without Buddycare's express prior written consent. 

Conditions Relating to the Sale of Products to You 

This section deals with conditions relating to the sale of products by Buddycare to you. 

6. Sale of goods
   Goods will be sold to domestic keepers of animals only.
7. Our contract
   When you place an order to purchase a product from Buddycare, Buddycare will send you an email confirming receipt of your order. The email confirmation will be produced automatically so that you have confirmation of your order details. An automatic confirmation does not necessarily mean that Buddycare will be able to meet your order.
8. Returns
   We are unable to offer refunds or accept returns on the following products.

• Animal medicines which have been used, part used or opened.
•  Any good which subsequently have become out of date

This includes items ordered in error, unless you contact us to cancel the order before it is dispatched. 

In the unlikely event that you receive faulty or damaged goods please contact us at hello@buddycare.co.uk within 72 hours of receipt of your goods. Please have your order reference to hand. You will be asked to provide evidence of the damaged goods if damaged in transit. 

9. Pricing and availability

9.1 Despite Buddycares's best efforts, a products in the Buddycare catalogue may be mispriced. Rest assured, however, that Buddycare verify prices as part of their dispatch procedures. If a product's correct price is lower than Buddycare's stated price, Buddycare will charge the lower amount and send you the product. If a product's correct price is higher than Buddycare's stated price, Buddycare will, at their discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation. 

9.2 All prices are stated in £ pounds sterling and including VAT where applicable.. 

9.3 In the rare case a product is ordered and is found later to be out of stock Buddycare will notify you as soon as possible and cancel your order. 

9.4 To keep our prices as low as possible, we keep our stock to a minimum. We order stock from our wholesaler at 4.30 each day, so any orders received after this time will not be ordered until the following day. 

9.5 Delivery is usually within 2 working days, however if we do not receive payment in time, your order may be delayed. 

9.6 Orders placed on a Friday will not be dispatched until the following Monday.  

9.7 For international orders our delivery charges exclude any customs duty, goods and services tax and retail sales tax. This is payable by the recipient. 

10. Children
    Buddycare does not offer for sale or sell products for purchase by children.
11. Electronic communications
    When you visit the Website or send emails to Buddycare, you are communicating with us electronically. Buddycare may communicate with you by email or by posting notices on the Website. For contractual purposes, you consent to receive communications from Buddycare electronically and you agree that all agreements, notices, disclosures and other communications that Buddycare provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
12. Alteration of Service or Amendments to the Conditions
    Buddycare reserve the right to make changes to the Website, policies, and these Terms and Conditions of Use & Sale at any time. You will be subject to the policies and the Terms and Conditions of Use & Sale in force at the time you use the Website or when you order goods from Buddycare, unless any change to those policies or these conditions is required to be made by law or government authority (in which case that change will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
13. Events beyond our reasonable control
    Buddycare will not be responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond Buddycare’s reasonable control. This condition does not affect your statutory rights.
14. Disclaimer
    This website is provided by Buddycare on an ‘as is' and ‘as available' basis. Buddycare makes no representations or warranties of any kind, express or implied, as to the operation of this website or the information, content, materials, or products for sale on this website. You expressly agree that your use of this website is at your own risk.

To the full extent permitted by the applicable law, Buddycare disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Buddycare does not warrant that this Website, its Servers or emails which may be sent from Buddycare are free of viruses or other harmful components. Buddycare will not be liable for any damages of any kind arising from the use of this website, including, but not limited to direct, indirect, incidental, punitive and consequential damages.

    If you breach these conditions and Buddycare take no action, Buddycare will still be entitled to use its rights and remedies in any other situation where you breach these conditions.
16. Governing law and jurisdiction
    These terms are governed by English law. This means that a contract, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), will be governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
